Basic Warranty Against Defects In Materials And Workmanship
CinchSeal, LLC. (CinchSeal) sells the products with the intent that they are free of defects in manufacture and workmanship at the time of sale. CinchSeal warrants that each of its products will be free of defects in material and workmanship under normal use and service. However, the obligation of CinchSeal under this warranty shall be limited to the requirement that it make good at CinchSeal’s place of business any part or parts which are returned to CinchSeal within 180days from the date of installation on the equipment. Such return of the product to CinchSeal must be made with transportation charges prepaid. CinchSeal will then examine the product to determine if the product is in fact defective. The aforesaid warranty is expressly in lieu of all other warranties express or implied along with all other obligations or liabilities on the part of CinchSeal. CinchSeal does not authorize anyone to obligate CinchSeal in any way beyond the terms set forth above. We will provide without charge a repair kit or make design changes to enable two year service life.
CinchSeal does not warrant any product which has been the subject of misuse, negligence, accident, repair, or alteration which, in the judgment of CinchSeal affects the product’s ability or reliability.
THE WARRANTIES PROVIDED BY CINCHSEAL AS REFERRED TO ABOVE SHALL BE THE SOLE AND EXCLUSIVE WARRANTIES. THERE SHALL BE NO OTHER WARRANTIES EXPRESS OR IMPLIED INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS OR ANY OTHER OBLIGATION ON THE PART OF CINCHSEAL WITH RESPECT TO PRODUCTS COVERED BY THIS AGREEMENT.
IN NO EVENT SHALL THE WARRANTIES OF CINCHSEAL REQUIRE MORE FROM THE COMPANY THAN THE REPAIR OR REPLACEMENT OF ANY PART OR PARTS WHICH ARE FOUND TO BE DEFECTIVE WITHIN THE EFFECTIVE PERIOD OF THE WARRANTY. THE COMPANY SHALL HAVE NO LIABILITY FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES.
CinchSeal shall be under no obligation to the Buyer to manufacture, sell, or supply, or to continue to manufacture, sell, or supply any of the Products, and CinchSeal shall be under no obligation to the Buyer to continue, discontinue, or change any model or type of any of the Products hereunder.
